ARTICLE 2 — SUBJECT OF THE AGREEMENT

This Agreement governs the rights and obligations of the parties concerning the sale and delivery of products ordered electronically by the BUYER through the FANTEX EXCHANGE online store.

Payment transactions shall be processed through the payment systems currently active in the store.

The SELLER shall begin processing the order once payment has been successfully completed.

ARTICLE 5 — DELIVERY TERMS

FANTEX EXCHANGE aims to deliver orders within 1–3 business days under normal circumstances.

This period may vary depending on stock availability, delivery address, and the operating conditions of the shipping carrier.

Subject to applicable legal exceptions, orders shall be delivered within the period promised to the consumer and, in all cases, within the maximum period prescribed by applicable legislation.

If the SELLER fails to fulfill its delivery obligations, the BUYER retains all rights granted under applicable law.

ARTICLE 6 — RIGHT OF WITHDRAWAL

Except for the exceptions specified by applicable legislation, the BUYER has the right to withdraw from this Agreement within 14 days from the date of receiving the product, without providing any reason and without incurring any contractual penalty.

To exercise the right of withdrawal, the BUYER must provide the SELLER with an explicit notification within this period.

Notification may be sent to the following email address:

The exercise of the right of withdrawal and the procedures relating to the return of products shall be governed by applicable legislation.

The relevant legal exceptions shall apply to products for which the right of withdrawal cannot be exercised under the Regulation on Distance Contracts.

These include, in particular:

  • Products that are unsuitable for return for health or hygiene reasons where protective packaging, tape, seals, or similar protective elements have been opened after delivery.

  • Products specifically prepared in accordance with the consumer's requests or personal needs.

  • Other products excluded from the right of withdrawal under the applicable Regulation.

For men's underwear products, an exception to the right of withdrawal shall apply only where the relevant product meets the conditions specified by applicable legislation.

The consumer's statutory rights concerning defective products remain unaffected.

ARTICLE 8 — RETURNS AND REFUNDS

Where the BUYER properly exercises the right of withdrawal, refunds shall be processed in accordance with applicable legislation.

Refunds shall be issued within the periods prescribed by law and, as a general rule, through the payment method used by the BUYER at the time of purchase.

The applicable legislation and the information provided to the BUYER before placing the order shall govern return shipping costs and return procedures.

ARTICLE 9 — DEFECTIVE PRODUCTS

If a delivered product is defective, the BUYER may exercise the statutory remedies available under Turkish Consumer Protection Law No. 6502.

Subject to the conditions established by applicable legislation, these remedies may include a refund, replacement of the product, free repair, or a price reduction proportionate to the defect.

ARTICLE 10 — FORCE MAJEURE

In extraordinary circumstances beyond the control of the parties that prevent the fulfillment of contractual obligations, the provisions of applicable legislation shall apply.

Such circumstances shall not eliminate the consumer's statutory rights.

ARTICLE 11 — DISPUTE RESOLUTION

Any disputes arising from this Agreement shall fall within the jurisdiction of the competent Consumer Arbitration Committees and Consumer Courts, in accordance with the monetary thresholds and jurisdictional rules established by applicable legislation.

The BUYER retains all rights to submit applications and initiate legal proceedings under applicable law.

ARTICLE 12 — ENTRY INTO FORCE

Before completing the order, the BUYER shall be informed of the essential characteristics of the product, the total sales price, payment and delivery conditions, the right of withdrawal, and other required pre-contractual information.

This Agreement shall enter into force when the BUYER confirms the order electronically after receiving the required information.
