(iii) Agents must respond truthfully to any question or request intended to determine whether an interaction originates from a human or an automated system.
(iv) Agents must not bypass, circumvent, interfere with, or otherwise defeat any measure intended to prevent, restrict, modify, or control Agent access to, use of, or interaction with the Services.

SECTION 15 — TERMINATION
FANTEX EXCHANGE reserves the right to suspend, restrict, or terminate your access to the Services, or any part thereof, where reasonably necessary, including in cases of violations of these Terms of Service, fraudulent activity, security concerns, or other legitimate grounds.
Such actions shall be taken in accordance with applicable law and any mandatory consumer protection requirements.

SUCH DAMAGES MAY INCLUDE, WITHOUT LIMITATION, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF ANTICIPATED SAVINGS, LOSS OF DATA, BUSINESS INTERRUPTION, OR COSTS OF SUBSTITUTE GOODS OR SERVICES, TO THE EXTENT THAT SUCH LOSSES MAY LAWFULLY BE EXCLUDED.
This limitation applies regardless of whether a claim arises under contract, tort (including negligence), strict liability, or any other legal theory, and even if FANTEX EXCHANGE has been advised of the possibility of such damages, to the extent permitted by applicable law.
FANTEX EXCHANGE shall not be responsible for losses arising solely from errors, omissions, interruptions, or inaccuracies in general informational content made available through the Services, except where liability cannot lawfully be excluded.
NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, OR ANY OTHER LIABILITY THAT CANNOT LEGALLY BE EXCLUDED OR LIMITED.
